  • 1. Use of United Actuarial Service's Research Site (the "Site") is subject to the following Terms and Conditions. United Actuarial Services ("TIC") reserves the right, at its discretion, to change these Terms and Conditions. TIC will post notification of changes on the Site, or by E-mail, or by postal mail. By using the Research Site now, or after the posting of notice of any changes in these Terms and Conditions, you (the "User") accepts the most current Terms and Conditions.
    2. TIC owns or has instructions from its clients to display all information provided by TIC on the Site ("TIC Information"). Copyright laws and other intellectual property laws and treaties protect the TIC Information. All interests, including but not limited to copyright, in and to the TIC Information and all later copies are owned by TIC or its clients. The User may not modify, publish, transmit, transfer, reproduce, distribute, or display any of the TIC Information, in whole or in part, except that the User may download or copy the TIC Information displayed on the Site for personal use only if the User maintains all copyright and other notices contained in such TIC Information.
    3. Users entering or posting information or results on the Site are solely responsible for the content of same. Users will not upload to or otherwise publish through the Site any content that is libelous, defamatory, obscene, pornographic or abusive, violates or infringes the intellectual property rights of others or violates any law. While TIC does not and cannot review every item posted by Users, TIC reserves the right to delete, move, or edit content that it, in sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.
    4. TIC and its client(s) do not (1) guarantee the accuracy, timeliness, completeness or correct sequencing of the TIC Information, or (2) warrant any results for use of the TIC Information. Neither TIC nor its client(s) will be liable to the User or anyone else for any inaccuracy, error or omissions in the TIC Information or for any damages caused by the use of the TIC Information.
    5. User acknowledges the responsibility to safeguard his or her USER ID password and Personal Identification Number ("PIN"). User will not reveal or lend this sensitive information to anyone. User understands that TIC intends for the password and PIN to be for User's sole use. User will be responsible for all activity conducted under his or her password.
    6. User will not use the Site for any unlawful purpose or any other purpose prohibited by these Terms and Conditions.
    7. The Site contains links to other related World Wide Web Internet sites and resources outside the Site. TIC is not responsible for the content of these outside resources. Users should direct any concerns regarding any external link to its site administrator or Webmaster.
    8. Users agree to defend, indemnify, and hold TIC harmless for any damages, losses, costs, or expenses that TIC may incur arising from anything entered or posted on the Site by Users.
    9. TIC may offer some services on this Site conditioned on the payment of subscription fees. If the User buys subscription-based services, the User will pay all subscription fees incurred. The User will also pay all applicable taxes relating to use of those services.
    10. TIC reserves the right to send electronic mail to Users to inform them of changes to the Site or to these Terms and Conditions or about products and services related to the TIC Information.
    11. TIC reserves the right to reveal information about User usage and demographics, in forms that do not reveal Users' personal identities, to employee benefit plan trustees and to others.
    12. As with all web sites, the Site may be unavailable from time to time because of maintenance or other disruptions. TIC will try to reduce such downtime.
    13. TIC may, in its sole discretion and without notice or liability: a) change, suspend or end any feature or aspect of the Site; b) limit User access to parts of the Site; and c) end or suspend User's access to all or part of the Site, upon breach of any of these Terms and Conditions.
    14. These Terms and Conditions will be construed and enforced according to Indiana law. Any action arising under these Terms and Conditions must be filed in the federal or state court in Indianapolis.
